2. Definitions

• Service : The book creation service provided by FastRead.io using AI technology.
• User : Any individual or entity using the Service.
• Subscription : The access plan selected by the User, which may include free or premium plans.

3. Services Provided

5minbook.com FastRead.io helps customers create books with AI, which they can sell or give away. The Service is offered subject to acceptance of all of the terms and conditions contained in these TOS.

4. User Accounts and Responsibilities

• Account Creation : Users must provide their full name, email address, and payment information to create an account. Users must be at least 18 years old to register.
• Account Security : Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account. Users must notify MyAutoBio Inc. immediately of any unauthorized use of their account.

5. Subscription and Payment Terms

• Subscription Plans : We offer free and premium subscription plans. Premium plans can be billed monthly or annually. A 7-day free trial is available for new users of the premium plan.
• Billing and Payment : Billing cycles are monthly or annually, depending on the chosen subscription plan. Accepted payment methods include credit cards and PayPal.
• Refund Policy : All payments are non-refundable. Refunds are provided only in exceptional cases, such as billing errors or technical failures on our end.

6. Ownership of AI-Generated Content and Intellectual Property

• User Ownership : Users retain full ownership of the content they generate using the Service, including fan fiction and derivative works. Users are responsible for ensuring that their content does not infringe on third-party copyrights, trademarks, or other intellectual property rights.
• Compliance with Laws : Users must comply with all applicable laws and regulations, including those related to intellectual property, when creating and distributing content through the Service. MyAutoBio Inc. disclaims any responsibility for content that violates third-party rights and reserves the right to remove any infringing content upon notice.
• Marketing License : By using the Service, users grant MyAutoBio Inc. a non-exclusive, royalty-free license to use their content for marketing purposes, including ads, case studies, and website highlights. Users may opt out of this by emailing [email protected].
• License Restrictions : Users cannot reverse-engineer, decompile, or disassemble any software used by the Service. All intellectual property related to the Service, including software and trademarks, remain the property of MyAutoBio Inc.

7. Third-Party Services

• Use of Third-Party Services : The Service utilizes third-party providers, including OpenAI, Anthropic, Stripe, Supabase, and DigitalOcean. MyAutoBio Inc. is not responsible for any outages, errors, or inaccuracies caused by these third-party services. Users acknowledge and agree to the terms and conditions of these third-party providers
• Content Fact-Checking : Users are responsible for fact-checking any content generated by the AI. This includes ensuring that the content does not contain misinformation, adult content, or hate speech.

8. Privacy and Data Protection

• Data Collection : We collect personal information, payment details, and usage data. This data is used to enhance the Service and may be shared with third-party partners. By using the Service, you consent to such collection, use, and sharing of your data.
• Data Retention : We will store all user-generated content indefinitely. Users may request data deletion by emailing [email protected].

9. Service Availability and Support

• Availability : While we strive to provide reliable service, we do not guarantee uninterrupted access. The Service is provided on an "as available" basis. We reserve the right to suspend the Service for maintenance or updates without prior notice.
• Support : Support is available via email and live chat from 9 AM to 5 PM PST, Monday through Friday. We do not guarantee resolution times for support inquiries.

10. User Conduct and Acceptable Use

• Acceptable Use : Users must use the Service for lawful purposes only. Prohibited activities include, but are not limited to, uploading illegal content, harassing other users, and attempting to disrupt the Service.
• Content and Data : Users can create and upload content related to book creation. MyAutoBio Inc. reserves the right to review, remove, or modify any user-generated content that violates our policies without prior notice.

11. Content Moderation and Ethical Use of AI

• Moderation Policy : While MyAutoBio Inc. does not actively monitor content, we reserve the right to intervene in cases of urgent content violations, such as illegal activities, hate speech, or harmful misinformation.
• User Responsibility for Content : Users are solely responsible for the content generated by the AI, including ensuring that the content is lawful and does not contain misinformation, adult content, or hate speech.

12. Termination and Suspension

• Termination Conditions : We reserve the right to terminate or suspend user accounts at our sole discretion for any reason, including but not limited to violation of the TOS or inactivity for over 12 months. Upon termination, user data will be retained for 30 days before being permanently deleted.
• Effect of Termination : Upon termination, users will lose access to the Service and all data associated with their account.

13. Refund Policy

• Non-Refundable Payments : All subscription payments are non-refundable.
• Exceptional Refunds : Refunds may be provided in exceptional cases, such as billing errors or technical issues directly caused by MyAutoBio Inc. Users can contact [email protected] to request a refund review.

14. Indemnification

Users agree to indemnify, defend, and hold harmless MyAutoBio Inc., its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• User's use of the Service, including any content created, uploaded, or distributed through the Service.
• Any violation by the User of these TOS, including but not limited to violations of intellectual property rights, privacy rights, or any other third-party rights.
• Any claims that the User's content infringes upon or violates the rights of any third party.

This indemnification obligation will survive the termination of the User's account and continued use of the Service.

15. Governing Law and Dispute Resolution

• Governing Law : This agreement is governed by the laws of the state of Arizona, without regard to its conflict of laws principles.
• Binding Arbitration : Any disputes arising under these TOS will be resolved through binding arbitration in Scottsdale, Arizona. Users waive their right to participate in class action lawsuits against MyAutoBio Inc.

18. Fan Fiction and Derivative Works

Users may create fan fiction or derivative works using the Service, provided that such content does not infringe upon the copyrights, trademarks, or other intellectual property rights of third parties.

• Rights and Permissions: Users must have the necessary rights or permissions to create and distribute derivative works based on existing copyrighted material.
• Prohibited Content: The Service prohibits the creation of content that directly replicates copyrighted works without authorization.
• Disclaimers: Any fan fiction or derivative works must include appropriate disclaimers indicating that the content is not affiliated with or endorsed by the original creators or rights holders.
